TH / LE MORGANE implements the appropriate technical and organisational measures to guarantee a level of security that is adapted to the inherent risk of its processing operations, comply with regulatory requirements and protect the rights and data of the people concerned when designing processing operations.

Furthermore, TH / LE MORGANE contractually imposes the same level of protection of data protection on its subcontractors (service providers, suppliers, etc.).

2 - What data do we collect?

A - According to the purpose of the collection

The personal data we collect varies according to the purpose of the collection and the Service we provide. In general, we may be required to directly collect the following categories of data:

A - Methods used to collect your data

In the frame of our relationship, you may be required to send us your data using different methods and, in particular, our website, mobile site, online store and mobile apps while you are browsing the Internet, making purchases, bookings, completing various data collection forms, subscribing to the e-newsletter, creating an account, submitting an application, posting your comments on our social media pages, making any form of contact with our establishment, or sending us your data in any way.

  • Enable TH / LE MORGANE to record the Customer’s Booking request;
  • Enable TH / LE MORGANE to manage Bookings and ensure the follow-up of customer relations (booking confirmation, booking reminders, after-sales service, etc.);
  • Process the payment made by the Customer and issue any refunds;
  • Enable TH / LE MORGANE to compile accounting documents and supporting records in order to comply with certain legal obligations;
  • Process requests for information submitted by the User and/or the Customer via the contact form;
  • Send information and/or commercial offers from TH / LE MORGANE, subject to the express and prior consent of the User and/or the Customer;

  1. LEGAL BASES FOR THE PROCESSING OF PERSONAL DATA

The processing of Data carried out by TH / LE MORGANE is based on several legal bases pursuant to Article 6 of the GDPR.

(i) Article 6.1 b. of the GDPR: Processing is necessary for the performance of a contract to which the Data Subject is party, or in order to take steps at the request of the Data Subject prior to entering into a contract (Management of customer relations, in particular sending a booking confirmation email after payment and acceptance of the GTS);

(ii) Article 6.1 c. of the GDPR: Processing is necessary for compliance with a legal obligation to which the Controller is subject (in particular Article L. 123-22 of the French Commercial Code and Article L. 34-1 of the French Postal and Electronic Communications Code) – (Compilation of accounting documents and records);

(iii) Article 6.1 a. of the GDPR: The Data Subject has consented to the processing of their Data for one or more specific purposes (Sending of commercial offers following acceptance by the Data Subject,Audience data where the Data Subject has consented to the cookie management policy);

(iv) Article 6.1 f. of the GDPR: Processing is necessary for the purposes of the legitimate interests pursued by the Controller (After-sales follow-up).

 

 

  1. RIGHTS OF DATA SUBJECTS

 

6.1. Information

In accordance with the Applicable Regulations, the Data Subject may exercise the following rights with TH / LE MORGANE:

  • TH / LE MORGANE and more specifically the staff authorised by reason of their duties (sales department, customer service, legal department, etc.);
  • Authorised processors and service providers of TH / LE MORGANE (Partners in particular), it being specified that the contract signed between such processors / service providers and TH / LE MORGANE sets out the obligations regarding the protection of the Data entrusted to them.

The Data may also be made available to the competent public authorities where required by law or upon formal request.

  1. DATA TRANSFERS

8.1. General provisions

External service providers or partners of TH / LE MORGANE to whom Data is transmitted process such Data:

(i) Either as a controller (in particular banks, etc.), for the purposes of managing Users’ access to the Services, or;

(ii) Or as processors (in particular hosting providers, payment service providers, carriers, communication agencies, Google Analytics, Google Ads, Facebook, etc.).

The contract signed between the external service providers and/or partners and TH / LE MORGANE sets out the obligations regarding the protection of the Data entrusted to them.

The Data may be transferred and processed outside the European Union, in particular in order to host the Data or where the Data is used on social networks.

In such cases, and prior to any transfer, TH / LE MORGANE ensures that the transfer of such Data is secure. In the event that the legislation of the country concerned by the Data transfer has not been recognised as providing an adequate level of Data protection, TH / LE MORGANE undertakes to put in place the necessary measures in accordance with the Applicable Regulations (cross-border data flow agreements compliant with the standard contractual clauses issued by the European Commission).

 

  1. METHOD AND SECURITY OF PERSONAL DATA PROCESSING

TH / LE MORGANE processes the Data collected with all due care and takes all necessary security measures to prevent unauthorised access, disclosure, alteration or unauthorised destruction of the Data. To this end, the processing of the Data is carried out using computers or IT tools and by following procedures and organisational methods closely linked to the stated purposes of the processing.

The User is informed that the Data relating to their bank details is processed securely on behalf of TH / LE MORGANE by its service provider PLANET PAYMENT, a recognised international security standard.

 

  1. DATA RETENTION PERIOD

In accordance with the Applicable Regulations, the Data processed is retained in the active database for as long as is necessary to fulfil the purposes for which it was collected and, more generally, for as long as is necessary for:

  • the management of the Booking (placing the Booking, after-sales service, complaints, refunds, etc.);
  • the communication of information and/or commercial offers from TH / LE MORGANE, if the Customer has given their express and prior consent;
  • the discharge of the legal retention obligations incumbent on TH / LE MORGANE
  • the compilation of statistics to be used by TH / LE MORGANE, in particular to improve its Website, and/or shared with third parties.

After five (5) years of inactivity on the Website, the Data is automatically purged so that only pseudonymised and/or anonymised data is retained, in compliance with the legal, accounting and tax obligations incumbent on TH / LE MORGANE.

In order to resolve disputes, prevent fraud and abuse, enforce the GTS and/or comply with legal obligations, TH / LE MORGANE reserves the right, in compliance with legal and regulatory requirements, to retain certain of the Data processed for a limited period, even where it is no longer necessary for the Booking (for example, billing Data is retained for 10 (ten) years in intermediate archiving pursuant to Article L. 123-22 of the French Commercial Code).

In any event, save for exceptions relating to TH / LE MORGANE’s legal obligations, the retention period for personal Data will not exceed five (5) years in the active database followed by two (2) years in intermediate archiving in pseudonymised form.

11.1. Legal action

The Personal Data collected may be used for legal purposes by the Controller, before the Courts or at any stage leading to possible legal action arising from improper use of the Website or related services.

The Data Subject is aware that public authorities may require the Controller to disclose their Personal Data.

For operating and maintenance purposes, the Website may collect files that record interactions with the said Website (system log) or use any Personal Data for this purpose (such as the IP address).
